Delhi HC Judge recuses from hearing bail plea of UAPA accused
Justice Siddharth Mridul of the Delhi High Court on Tuesday recused from hearing the plea moved by Manzer Imam, a purported Indian Mujahideen operative.
Imam is booked under anti-terror law, the Unlawful Activities (Prevention) Act (UAPA).
“In all the bans imposed on the organizations at that time, I was the Senior Counsel for the Government, so I can’t hear the matter,” Justice Mridul said.
The matter is listed for hearing on January 13 before another bench.
The National Investigation Agency (NIA) filed a case against Imam in August 2013 stating that he and others conspired to commit terrorist activities and made plans to target important locations in the nation.
Imam recently received a bail denial from the trial court. In October last year, a single judge requested that his bail application be heard and decided by the special court within 75 days.
“The Special Court will hear and dispose of the bail application of the applicant within 75 days from the date of this order,” the court had ordered.
Justice Mridul acknowledged his difficulty in hearing the appeal when Imam’s counsel said that the accused had been in detention for nine years and that the charges against him had been re-filed. He had further stated that there are 369 witnesses, and many of them are yet to be examined.
“In some of the bans imposed on SIMI (Students’ Islamic Movement of India)… for a period of two years I was a senior counsel for the government. Would I hear this matter?…There is a difficulty,” said Justice Mridul.
However, on November 28, Additional Sessions Judge Shailender Malik ruled that the trial’s delay in this case could not be used as a defence to grant bail.
The court had denied Imam’s request for bail but stated that there was sufficient proof to conclude that his accusation was true. Because the trial was taking so long, Imam had asked for bail.
The FIR in which Imam is an accused invokes Section 17, 18, 18B and 20 of UAPA and Section 121A and 123 of Indian Penal Code.

Mumbai: Mafia kingpin Dawood Ibrahim’s right-hand man and drug smuggler Salim Dola was arrested by the Central Narcotics Control Bureau (NCB) on charges of drug trafficking, but today the court has sent him to judicial custody. The defense lawyer told the court that Salim Dola should not be kept in judicial custody in Arthur Road. The court rejected this and ordered that Dola be kept in Arthur Road. Salim Dola was brought to Mumbai through extradition. The Mumbai Crime Branch has filed an application in the Fort Court to get his custody. However, the court has not taken any decision in this regard yet. When Salim Dola appeared in court, the defense lawyer had requested the court not to keep him in Arthur Road Jail. When the defense lawyer asked the defense lawyer whether Salim Dola’s life was in danger from his enemies and other prisoners and gangs, the defense lawyer called it a personal conversation between the lawyer and the client and said that his client had told him that he should be kept in Arthur Road Jail. The court has dismissed him and further investigation is underway with Saleem Dola in this case. In this regard, the Crime Branch has also now sought Saleem Dola’s custody. The Mumbai Crime Branch will question Saleem Dola in the case of exposing drug factories in Maharashtra and Karnataka. Saleem Dola is said to be an international drug smuggler.

Navi Mumbai Shocker: Stepfather Booked For Rape Of Minor After Victim Discloses Two-Year Abuse During His Judicial Custody In Separate Case

Navi Mumbai: Panvel City police have registered a case against a 34-year-old man for allegedly sexually assaulting his 15-year-old stepdaughter over two years in Panvel. The accused has been booked under rape charges and provisions of the Protection of Children from Sexual Offences (POCSO) Act.
Police said the minor was living with her mother and stepfather in Panvel. The abuse began in August 2024 when the accused allegedly assaulted her while she was alone at home. He reportedly threatened to kill her if she told anyone, causing her to stay silent for two years.
The case came to light after the accused was arrested on April 15 in a separate assault case involving a fight with neighbors. While in judicial custody at Taloja jail, the victim disclosed the abuse to her mother, leading to a formal complaint at Panvel City police station.
Based on the complaint, police registered a case against the accused under sections 64(1) and 351(2) of the Bharatiya Nyaya Sanhita (BNS), and sections 4 and 6 of the POCSO Act.
Assistant Police Inspector Rajendra Ghevdekar is investigating the case under the guidance of Senior Police Inspector Nitin Thakare. The accused remains in judicial custody, and further legal proceedings are underway.

45-Year-Old Peon Arrested For Allegedly Touching 6-Year-Old Student Inappropriately In School In Mumbai Govandi

Mumbai: An incident has come to light from a renowned school in Govandi, where a 45-year-old peon has been arrested for inappropriately touching a 6-year-old student.
The accused, identified as Rajesh Mahakal, had allegedly been misbehaving with the child for the past year. He allegedly took the child to an empty room inside the school premises and touched him inappropriately.
The matter came to light after the child informed his family about the incident. Following this, the family immediately approached the Govandi police station and lodged a complaint against the accused.
Taking serious note of the complaint, the police registered a case against the peon and arrested him under the Protection of Children from Sexual Offences (POCSO) Act.
Police officials told Media that they have launched a further investigation into the matter by reviewing CCTV and interrogating staff.
This comes a few months after the Malad police arrested a 35-year-old man for allegedly molesting a 4-year-old student at a private school in Malad West. The incident occurred on January 12, and the police arrested the accused on February 6.
The accused, who worked as a peon at the school, was booked under the POCSO Act (Protection of Children from Sexual Offences) for allegedly inappropriately touching the child. The minor shared the ordeal with her parents, who then approached the police. After registering the case, the police subsequently arrested the man.
The court has remanded him to police custody for one day. Meanwhile, the police asked the school trustee for CCTV footage, but the trustee denied the request and had not informed the police in time. Subsequently, the police registered a case against the trustee as well.
