SC agrees to examine Uddhav Thackeray plea against EC decision on Wednesday
Maharashtra: The Supreme Court on Tuesday agreed to hear on Wednesday a plea by Uddhav Thackeray against the Election Commission of India (ECI) decision recognising the Eknath Shinde faction as the official Shiv Sena.
Senior advocate Kapil Sibal, representing Thackeray, submitted before a bench headed by Chief Justice of India D.Y. Chandrachud that if the ECI order is not stayed then they will take over everything, bank accounts, etc. Sibal said, “My only request is, take up the matter tomorrow morning with the constitution bench matters.”
The bench, also comprising Justice P.S. Narasimha, said they don’t want to disrupt the constitution bench as there are three judges waiting and added, “we will finish the constitution bench and get up a little early and then take it up tomorrow”. Sibal requested the bench to take up the matter Tuesday only.
The Chief Justice said, “We have not read it yet…tomorrow.” The bench decided to take up the matter at 3.30 p.m. on Wednesday.
Thackeray, in the plea filed through advocate Amit Anand Tiwari, said the ECI has failed to appreciate that the petitioner enjoys overwhelming support in the rank and file of the party. “The petitioner has an overwhelming majority in the Pratinidhi Sabha, which is the apex representative body, representing the wishes of the primary members and other stakeholders of the party. The Pratinidhi Sabha is the apex body recognised under Article VIII of the Party Constitution. The petitioner enjoys the support of 160 members out of approximately 200 odd members in the Pratinidhi Sabha”, it added.
The plea contended that the ECI has failed to discharge its duties as a neutral arbiter of disputes under para 15 of the symbols order and has acted in a manner undermining its constitutional status.
On February 17, the Election Commission allotted the Shiv Sena party name and the bow and arrow symbol to the faction led by Eknath Shinde.
“The ECI has disregarded the party Constitution of 2018 (which was admitted even by the respondent No.1 to be the Constitution governing the parties) on the ground that such a constitution is undemocratic and that it was not communicated to the Commission. These observations are totally erroneous as the amendments in the Constitution were categorically communicated to the Commission in 2018 itself and the petitioner will place clear evidence in this regard,” said the plea, seeking interim stay on the ECI order passed on February 17.

Mumbai: ‘Ghar Mein Ghuske Marenge..’, MNS Leader Avinash Jadhav Vows Revenge After Mob Forces Marathi Youth To Apologise Over Language Row In Mumbra
Mumbai: A young man demanding the use of Marathi was forced to apologise by a mob recently, sparking a major controversy. The incident took place on Thursday in Mumbra when a Marathi youth, Vishal Gawli, asked a non-local fruit vendor to converse in Marathi.
In retaliation, the vendor and a crowd compelled him to apologise in Hindi and hold his ears. The Maharashtra Navnirman Sena (MNS) has expressed outrage over this incident, while the Mumbra police, instead of supporting the Marathi youth, filed a non-cognizable offence against him based on the complaints of the fruit vendors.
Avinash Jadhav Expresses Frustration Over Language Dispute Incidents
Speaking to Marathi news channels, MNS leader Avinash Jadhav said, “This is the fourth incident in the Thane district alone, following similar cases in Kalyan, Thane, and Nalasopara. If a boy asking someone to speak in Marathi has to apologize in Maharashtra, it is deeply unfortunate. What is the point of granting Marathi the status of a classical language if no laws are in place to protect its dignity?”
Jadhav stressed the need for laws alongside recognition of Marathi as a classical language. “If Marathi is not respected in Maharashtra, then what use is this status? There must be a law stating that derogatory remarks or refusal to acknowledge Marathi will result in legal action. I will approach the DCP about this incident. It is appalling that those opposing the youth had the audacity to shout slogans at the police station and demand action against him,” he stated. He also demanded immediate action against the mob, highlighting that the youth was threatened and humiliated for defending Marathi.
Jadhav’s Warning To Anyone Who Tries To Harm The Youth
Expressing strong support for Vishal Gawli, Jadhav declared, “The boy is scared now, but the MNS stands firmly by him. If anyone dares to harm him, we will enter their homes and show them what the Maharashtra Navnirman Sena is capable of.”
What Exactly Led To The Controversy?
The incident occurred when Vishal, visiting a fruit vendor to purchase goods, inquired about prices in Marathi. The vendor, Shoaib Qureshi, became agitated, stating he could only speak Hindi. When Vishal questioned why the vendor, living in Maharashtra, didn’t know Marathi, a heated argument broke out, drawing a large crowd. The mob forced Vishal to apologise, and a video of the incident went viral. The youth was eventually handed over to the police, who registered a case against him.
