Delhi HC reserves order on plea seeking 2018 Collegium meeting details

Published

on

The Delhi High Court on Monday reserved its order in a plea seeking a copy of the details and agenda of the Supreme Court collegium meeting held on December 12, 2018, in connection with the appointment of judges in the apex court.

Justice Yashwant Varma was dealing with the petition challenging the Central Information Commission (CIC) order which refused to give details on a Right to Information Act plea about the meeting which was not made public yet.

During the course of the hearing, Senior Advocate Prashant Bhushan appeared for the petitioner Anjali Bharadwaj. After hearing the submissions, the bench reserved the matter.

Seeking the details of the collegium, the petitioner filed the RTI application on February 26, 2019. However, the petitioner was informed that the information sought was held to be not proper by the First Appellate Authority (FAA) and therefore not relevant.

The plea referred to an earlier quote of former apex court judge Madan Lokur who had expressed his disappointment over the Supreme Court Collegium’s December 12, 2018 resolution of elevating Justice Pradeep Nandrajog and Justice Rajendra Menon to the Supreme Court not being put in the public domain.

As opposed to the December 12, 2018 collegium decision of which Justice Lokur was a part, the collegium later recommended elevating Justice Dinesh Maheshwari and Justice Sanjiv Khanna to the Supreme Court, superseding as many as 32 other judges, triggering a controversy at that time.

“The then Collegium on 12th December 2018 took certain decisions. However, the required consultation could not be undertaken and completed as the winter vacation of the Court intervened. By the time the Court re-opened, the composition of the Collegium underwent a change. After extensive deliberations on 5th / 6th January 2019, the newly constituted Collegium deemed it appropriate to have a fresh look at the matter and also to consider the proposals in the light of the additional material that became available,” the present petition read.

New Delhi, September 30: An RPG that targeted the Punjab Police’s Intelligence Headquarters in Mohali last year was actually intended for singer and rapper Sidhu Moosewala, who was shot dead in May 2022, top sources in the Delhi Police revealed. The sources said the perpetrators altered their plan, fearing a higher casualty count if the attack occurred during a gathering or meeting.

The RPG was supplied by Khalistani terrorist Harwinder Singh Sandhu

“The RPG was supplied by Khalistani terrorist Harwinder Singh Sandhu, alias Rinda and it was originally meant to be used to assassinate Sidhu Moosewala when he was at a public rally or event,”.

However, a shift in plans occurred, and the alleged gangsters and terrorists opted to target the Mohali headquarters instead in October 2022. This revelation was brought to light during an interrogation with incarcerated gangster Lawrence Bishnoi.

The RPG was illicitly smuggled into India through the Pakistan border

According to the police sources, the RPG was illicitly smuggled into India through the Pakistan border, implicating the Inter-Services Intelligence (ISI). Rinda had reportedly enlisted members of Bishnoi’s gang to carry out the operation.

Further investigation uncovered that Canada-based fugitive terrorist Lakhbir Singh Landa had collaborated with Rinda, sharing manpower, logistics, and resources and he was also the second in command.

Rinda had previously been linked to a grenade attack

Rinda had previously been linked to a grenade attack at the Crime Investigation Agency (CIA) office in Nawanshahr, Punjab, as well as the arrest of four suspected terrorists with ties to Pakistan in Haryana’s Karnal earlier in the same year.

The RPG attack in Mohali on May 9, 2022, was revealed as a conspiracy orchestrated by the Babbar Khalsa International (BKI), with the support of the ISI and local gangsters.

The attackers were apprehended by the Delhi Police

The attackers, identified as Deepak from Surakhpur village in Haryana and a juvenile accomplice, were apprehended by the Special Cell of the Delhi Police five months after the incident. It was established that Rinda masterminded the attack.

Punjab Police successfully apprehended the main accused, Charat Singh, a key operative and associate of Lakhbir Singh Landa, in a joint operation with central agencies and the ATS in Maharashtra. Landa, originally from Tarn Taran district in Punjab, had relocated to Canada in 2017 due to police pressure.
