Mira Bhayandar: The Navghar police have registered an offence against a 45-year-old man for defying orders passed by the Sub Divisional Magistrate (SDM) of Thane district for paying monthly maintenance to his elderly mother. However, the accused is yet to be arrested.

In her petition before the court of the SDM, the elderly woman had sought maintenance from her son-Chandan Rajendra Agarwal (45)- a resident of Bhayandar (east) under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act- 2007.

In response to the petition, the SDM passed an order on 5, June, 2024 directing Chandan to pay a monthly maintenance amounting Rs.10,000 to her mother and duly submit receipts of payments before the competent authority.

However, Chandan defied the ruling by denying monthly maintenance, prompting his mother to register a complaint at the upper tehsildar’s office. Despite being issued summons to register his say on the petition and the subsequent complaint, Chandan remained absent on both the occasions. Irate over the defiance, the upper tehsildar and the executive magistrate authorised revenue officer-Tushar Khedkar to register an offence against Chandan.

Based on Khedkar’s complaint, the Navghar police in Bhayandar police registered an offence under the relevant sections of the Maintenance and Welfare of Parents and Senior Citizens Act- 2007 against Chandan on Monday (2, December).

Enacted to provide financial security, welfare, and protection for senior citizens/parents, the key provisions of the act legally obligate children and heirs to provide a monthly allowance to their parents. The SDM or Tribunal can order maintenance and also levy interest in case of default.
