‘Patna FIR best be regarded as Zero FIR and transferred to Mumbai’

Rhea Chakraborty in her written submissions in the Sushant Singh Rajput death case told the Supreme Court on Thursday that the Patna FIR of July 25, could at best be regarded as a zero FIR and transferred to the Mumbai Police.

She also insisted that Rajput’s father has made baseless allegations against her. The apex court has already reserved the verdict on Rhea’s transfer plea.

“A plain reading of the subject FIR is clearly indicative of the fact that no such consequence of such alleged act has ensued within the State of Bihar. The maximum that may be done in such instance, is for the FIR to be registered as a “Zero FIR” and the same may be forwarded to the police station having jurisdiction over the matter,” said Rhea in the written submissions.

Rhea contended that the investigations in Bihar are “totally illegal and such illegal proceedings cannot be transferred to the CBI in the present manner by way of illegal executive orders”.

“The Petitioner has no objection if the transfer of investigation to CBI is done in exercise of powers conferred upon this court under Article 142 of the Constitution of India. Otherwise, the present transfer from Bihar Police to CBI as is done is totally without jurisdiction and contrary to law,” said the written submission.

She argued that transfer of investigation to CBI at the behest of Bihar Police is wholly without jurisdiction.

“Admittedly, the case registered by the Bihar Police was transferred to the CBI for the reasons of a)’sensitivity’ and b) ‘inter-state ramifications’. The concept of sensitivity is alien to criminal jurisprudence. There is not even a remote whisper of any material to support the theory of ‘inter-state ramification’. The offence if at all, as alleged is completely within the jurisdiction of Mumbai even as per the ED,” said the written submission.

It also added that in any case, a perusal of the FIR would indicate that no cognizable offence has been made out even on the facts and circumstances mentioned in the FIR.

“The averments in the FIR in no manner indicate how the alleged actions of the Petitioner led to the suicide of the deceased. Thus, the very registration of an FIR based on such contrary facts and baseless allegations without any substance demonstrate the illegality of the entire process.

“Hence, it is humbly submitted that in such circumstances, no transfer to CBI is mandated or made out and the allegation if any, ought to be investigated under the jurisdiction/supervision of the competent court in Mumbai,” said the submissions.

Simone Khambatta deposes before NCB, Rakul yet to respond

Fashion designer Simone Khambatta on Thursday deposed before the Narcotics Control Bureau (NCB) while Bollywood actor Rakul Preet Singh is yet to join the investigation into drugs abuse among people associated with the film industry, officials said.

According to NCB officials, Khambatta arrived at the NCB office here for questioning around 10.15 a.m.

An NCB official said that Rakul’s summons were issued on Wednesday but she has not yet responded on any available contact so far.

The NCB has also summoned several Bollywood actors, including Deepika Padukone, Shradhha Kapoor, Sara Ali Khan for questioning in a drugs related case.

On Wednesday, besides Deepika, the NCB sent summons to her manager Karishma Prakash for questioning on Friday and Sara and Shradhha for questioning on Saturday.

The NCB registered a case under the NDPS Act on the request of the Enforcement Directorate (ED) probing the money laundering charge into the death of Bollywood actor Sushant Singh Rajput.

The official said that it registered case after few alleged chats of Sushant’s girlfriend Rhea Chakraborty, her brother Showik, Sushant’s house manager Samuel Miranda discussing drugs came to the fore.

Following the alleged chats, the NCB questioned Rhea, Showik, Sushant’s former manager Shruti Modi, talent manager Jaya Saha, Kwan talent management agency CEO Dhruv Chitgopekar, Udta Punjab Producer Madhu Mantena Varna and several others.

Responding to a question on the number of cases the drug law enforcement agency is probing, an NCB official said: “The agency has registered two separate cases under NDPS Act. There are few aspects in both cases which warrant examination of both Sara and Shraddha, so they will be examined in both cases.

The official said that both cases are of NCB and have common link.

The NCB has already arrested Rhea, Showik, Miranda, Sushant’s personal staff Dipesh Sawant and 16 others in the case so far.

Rhea, Showik, Miranda and Sawant are currently in judicial custody.

The official said while the alleged chats of Deepika with her manager Prakash discussing drugs in October 2017 has brought her role to the fore, Shradhha and Sara’s role came to the fore following the questioning of Saha.

The NCB is the third Central agency to probe the death of Sushant besides the CBI and the ED.

Ankita, the former girlfriend of late actor Sushant Singh Rajput, took to Instagram and shared a picture where she looks stunning in a white sari and is smiling at the camera.

Ankita recently planted saplings in memory of Sushant. Her dog Hatchi is also seen in the pictures she posted.

“Hatchi and mamma. My partner in almost everything, Planting plants seedling. It’s our way to remember him by fulfilling his dream,” she captioned the snapshots, tagging them #plants4SSR.

Sushant was found dead at his Mumbai home on June 14. Initially, Mumbai Police had said it was a case of suicide. Now, his death is being investigated by CBI, Narcotics Control Bureau and Enforcement Directorate.

Neha and Ila are currently shooting for the film, “Aafat-e-Ishq”, and Neha pointed out Ila had “incredible energy” that was “contagious”.

“It has been a fun ride shooting for the film. Everyone on the set has been super enthusiastic. The entire team is extremely brave, hardworking and passionate about this film, else shooting during times of Covid would be impossible. For me, the highlight was (getting) to work an incredible cast and crew, especially Ila Arun ma’am,” Neha said.

About the film, she added: “It’s a quirky film that we hope will bring a smile to everyone watching. We are still in the middle of the shoot and it has been nothing short of exciting.”

“‘Aafat-e-Ishq’, is based on award-winning Hungarian film, “Liza, The Fox-Fairy”. The film is directed by Indrajit Nattoji. The Zee5 original film also features Namit Das, Deepak Dobriyal and Amit Sial and is currently being filmed in Nashik.
